The swelling body of <a href=\"https:\/\/eur03.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.ucl.ac.uk%2Flaw-environment%2Fblog-climate-change-and-rule-law%2Fclimate-change-and-rule-law-case-typology&amp;data=04%7C01%7C%7C8a621d07ae3f4913426208d9a38c575d%7C87879f2e73044bf2baf263e7f83f3c34%7C0%7C0%7C637720645412306687%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&amp;sdata=C1ybgxkauKLLAthVjpciSnN%2FArf%2FuSiTIYrQxtuBz9o%3D&amp;reserved=0\">pro climate litigation<\/a> counts hundreds of lawsuits raising questions of law or fact regarding climate science, climate change mitigation or adaptation, which have been brought before international or domestic judicial, quasi-judicial and other investigatory bodies. This practice has been amply documented in the literature and has been increasingly showcased in global litigation databases, such as those curated by the <a href=\"https:\/\/eur03.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fclimate-laws.org%2F&amp;data=04%7C01%7C%7C8a621d07ae3f4913426208d9a38c575d%7C87879f2e73044bf2baf263e7f83f3c34%7C0%7C0%7C637720645412316687%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&amp;sdata=sWCDBNOlvuBHmRN%2Bo2bSiajlBlKFU8Sj4RXLrC4DJAo%3D&amp;reserved=0\">Grantham Research Institute on Climate Change and the Environment<\/a> and the &nbsp;<a href=\"https:\/\/eur03.safelinks.protection.outlook.com\/?url=http%3A%2F%2Fclimatecasechart.com%2Fclimate-change-litigation%2F&amp;data=04%7C01%7C%7C8a621d07ae3f4913426208d9a38c575d%7C87879f2e73044bf2baf263e7f83f3c34%7C0%7C0%7C637720645412316687%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&amp;sdata=RODZ%2FmMuFskn3xgogqFzKBZju3%2B6zhTHh4MkrTkpVLs%3D&amp;reserved=0\">Sabin Centre for Climate Change Law at Colombia Law School<\/a>&nbsp;<\/p>\n\n\n\n<p>At the same time, as measures to address the climate emergency are adopted and implemented all over the world, groups negatively affected by transition laws and policies \u2014 e.g. restricting land uses or authorising the development of dams and windfarms \u2014&nbsp; are also increasingly resorting to litigation. In this connection, the idea of a \u2018<a href=\"https:\/\/eur03.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.tandfonline.com%2Fdoi%2Fabs%2F10.1080%2F14693062.2019.1657379%3FjournalCode%3Dtcpo20&amp;data=04%7C01%7C%7C8a621d07ae3f4913426208d9a38c575d%7C87879f2e73044bf2baf263e7f83f3c34%7C0%7C0%7C637720645412326680%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&amp;sdata=pRh%2BoNHWrxGSnz9CnE8jTcVtEyAmFt3ohGfsT7wplVo%3D&amp;reserved=0\">just transition<\/a>\u2019 away from fossil fuels suggests that the benefits of decarbonisation should be shared, and that those who stand to lose should be supported. In a recent piece, <a href=\"https:\/\/eur03.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fpapers.ssrn.com%2Fsol3%2Fpapers.cfm%3Fabstract_id%3D3928385&amp;data=04%7C01%7C%7C8a621d07ae3f4913426208d9a38c575d%7C87879f2e73044bf2baf263e7f83f3c34%7C0%7C0%7C637720645412326680%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&amp;sdata=7sMGIo3qNFR%2B9BES23Fwk0oJUM8Ilerp5rRTrm00frs%3D&amp;reserved=0\">Savaresi and Setzer <\/a>&nbsp;define \u2018just transition litigation\u2019 as lawsuits that question the distribution of the benefits and burdens of the transition away from fossil fuels and towards net zero emissions. They furthermore note that, while we know that this litigation is happening, at present there are no comprehensive data collections of these cases.
