Description:
The Russian use of force against Ukraine has been widely condemned as an act of aggression and as such as a blatant violation of the United Nations Charter. Article 2(4) of the Charter, which outlaws the use of force in international relations, is a foundational principle of the post war world order. It is thus not surprising that according to many commentators Ukraine is not only fighting for its existence, but also for the future of the rules based international order itself. Since the unlawful annexation of Crimea in 2014 Ukraine has seized every possible jurisdiction to hold Russia and its representatives to account. In addition, together with its allies – mainly western liberal democracies – Ukraine now seeks to create new accountability mechanisms where the existing ones are deemed insufficient for full accountability. These ‘gaps’ are the prosecution of the crime of aggression and the issue of reparations. This talk will dwell on these efforts and their challenges from the perspective of international law.
